Some of our representative business matters include:
- Obtaining dismissal of a federal court action against our client—one of the U.S. largest importers of fresh produce. Plaintiff, a U.S. based produce distributor, sued our client for alleged breaches of contract, fraud, tortious interference, and breach of fiduciary duty stemming from a joint venture. Despite having very strong defenses to the case on the merits (as well as very strong counterclaims), the client’s interests were best served by seeking dismissal of the case on forum non conveniens grounds. The Firm prevailed at the trial court and on appeal, where the Ninth Circuit affirmed in a published decision.
- Winning millions of dollars in arbitration awards concerning cancellation of contracts to distribute drinks in Mexico. The international arbitrations were conducted before separate arbitrators in parallel (and much of the testimony was in Spanish). We not only won for our client; we defeated counterclaims seeking millions of dollars in damages against the client.
- Defeating efforts by the late Michael Jackson (the self-styled “King of Pop”) to halt the auction of his personal property from Neverland Ranch. After the court denied Jackson’s request for an injunction, the Firm extracted a multimillion-dollar settlement from Jackson in exchange for cancelling the auction and returning Jackson’s property to him.
